It is the policy of the Mead Botanical Garden, Inc. (collectively, “Mead Botanical Garden”) to provide a workplace free from workplace harassment. Accordingly, any and all intimidation or harassment based on any of the above characteristics is strictly prohibited. In addition, Mead Botanical Garden will not tolerate retaliation against any employee for reporting a claim of sexual harassment or other workplace harassment in good faith.

What is Sexual Harassment?
Sexual Harassment is defined as follows: unwelcome sexual advances, requests for sexual favors, and other physical, verbal, or visual conduct based on sex may constitute sexual harassment when (1) submission to the conduct is an explicit or implicit term or condition of employment, (2) submission to or rejection of the conduct is used as the basis for an employment decision, or (3) the conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment.
Sexual harassment may include, but is not limited to, explicit sexual propositions, sexual innuendo, suggestive comments or questions, sexually oriented “teasing”, jokes about gender-specific traits, obscene or other inappropriate language, gestures, printed or visual material, repeatedly asking someone out who is not interested in dating, and physical contact such as patting, pinching, or brushing against another’s body or repeatedly standing too close to a person. A victim of sexual harassment can be a man or a woman. The victim may also be of the same sex as the harasser. The harasser can be a supervisor, co-worker, other Mead Botanical Garden employee, or a non-employee who has a business relationship with Mead Botanical Garden.
What is Workplace Harassment?
Workplace harassment of the type prohibited by this policy is verbal or physical behavior, including any form of denigration, referring to, or because of, a person’s color, race, national origin, gender, sex, sexual orientation, religion, age, disability, veteran’s status, marital status or any other classification protected by law that has the purpose or effect of creating an intimidating, hostile, or offensive workplace environment. All sexual harassment is workplace harassment, and this policy prohibits and provides a reporting mechanism for other forms of workplace harassment.
Any employee who is subject to harassment or intimidation should immediately contact the Executive Director or the President of the Board of Trustees to report the complaint. All complaints will be promptly and confidentially investigated. Any employee who violates this policy will be subject to appropriate disciplinary action, up to and including termination.
Reports of sexual harassment or workplace harassment made in good faith under this policy will not result in any adverse action being taken against the individual(s) making the report. No person who participates in good faith in an investigation under this policy will be treated adversely because of that participation. Any report alleging retaliation because of any (i) prior report of a possible violation of this policy or (ii) participation in an investigation of such a report will be investigated in the manner described above. Allegations of sexual harassment or workplace harassment should be made based on a good faith belief that sexual harassment or workplace harassment has occurred. Allegations determined after investigation to have been made in bad faith may subject the reporting employee to disciplinary action by Mead Botanical Garden up to and including termination of employment.
Volunteers
Mead Botanical Garden is lucky to enjoy the participation of many volunteers in its programming, the maintenance of its grounds and the daily routine of gardens. VOLUNTEERS ARE NOT EMPLOYEES OF MEAD BOTANICAL GARDEN. They shall, however, abide by the terms, conditions and requirements of this policy and upon any breach thereof, shall be asked not to return to Mead Botanical Garden grounds and all privileges as a volunteer shall be deemed revoked.
